What is I-9 Employment Verification?
I-9 Employment Verification involves completing the Form I-9, which is a federal document used to confirm that an employee is legally authorized to work in the United States. Employers must collect and retain this form for every employee they hire, whether they are citizens, permanent residents, or have temporary work authorization. The form requires employees to provide documentation that proves their identity and their right to work in the U.S.

The I-9 Employment Verification Process
-
Section 1: Employee Information and Attestation
-
Employee Completion: On or before their first day of employment, the employee must complete Section 1 of the Form I-9. This section requires the employee to provide their full name, address, date of birth, and other personal information. They must also attest to their citizenship or immigration status under penalty of perjury.
-
-
Section 2: Employer Review and Verification
-
Document Verification: Within three business days of the employee’s start date, the employer must complete Section 2. This involves reviewing original documents presented by the employee to verify their identity and work authorization. Common documents include a U.S. passport, Permanent Resident Card, or Employment Authorization Document.
-
Record Keeping: The employer must record the document information on the Form I-9 and confirm that the documents appear genuine and relate to the employee. Employers must retain the completed Form I-9 for a specified period, either three years after the date of hire or one year after the employee’s termination, whichever is later.
-
-
Section 3: Reverification and Rehires
-
Reverification: If an employee’s work authorization expires, the employer must reverify their employment eligibility by completing Section 3 of the Form I-9. This ensures continued compliance with employment authorization requirements.
-
Rehires: If an employee is rehired within three years of the original I-9 completion, the employer may update Section 3 instead of completing a new form, provided the employee’s work authorization is still valid.
